A crack on the windshield is a common problem for drivers that can appear unexpectedly, for example, because of a pebble from the wheels of another car. However, in addition to the risk of further growth of damage, the driver may threaten an administrative fine.
According to the newspaper "Your Machine", the police can fine the driver for operating a car with a crack on the glass, referring to DSTU 3649: 2010. According to these standards, the operation of transport is prohibited if the damage is in the area of work of the wiper . Such violations qualify under Part 1 of Article 121 of the Code of Administrative Offenses, which provides a fine of 340 UAH . In case of repeated violation, the amount increases to 1700 UAH , as well as possible deprivation of driver's license for 3-6 months or administrative arrest for 5-10 days .
Despite the fact that police are fined for cracks on glass, lawyers consider such actions illegal. They explain that paragraph 31.3 of the DA does not indicate cracks as a technical malfunction that prohibits the operation of the car. Thus, penalties under Article 121 of the Code of Administrative Offenses may be illegal and are subject to appeal .
