Iran filed a lawsuit against Ukraine, Canada, Sweden and the United Kingdom to the International Criminal Court, demanding the cancellation of the Council of the International Civil Aviation Organization (ICAO) on the involvement of Iran in the deliberate confusion of the Ukrainian Airlines (UIA) aircraft in 2020. The Iranian authorities challenge a report that recognizes Tehran responsible for a plane crash that happened on January 8, 2020, when the PS752 flight was shot down by the Iranian military.
In the text of the lawsuit, published on the official website of the International Criminal Court, Iran claims that ICAO had no jurisdiction to consider a complaint about the beating of a passenger aircraft, since Ukraine, as the plaintiff, did not carry out direct negotiations with Tehran on the incident. Iran noted that other states, including the United Kingdom, have not provided sufficient evidence of the presence of their citizens on board the aircraft, and the claim itself is "hostile and unacceptable." According to the Iranian authorities, the PS752 flight was shot down by Iran's military "inadvertently" and "due to human mistake". They explain the incident with the "incorrect definition and targeting" of two missiles without the necessary permission, which violated the mandatory military standards, and additionally state that increased combat readiness was caused by the expectation of attack from the US. The plane crash happened on January 8, 2020, when the Boeing-737 plane, which belonged to the International Airlines of Ukraine, was shot down by Iranian soldiers 60 km from Tehran. All 180 people on board, including crew members and passengers, were killed.
Iran first denied his involvement in the incident, but later acknowledged that the aircraft was shot down by the military. Ukrainian and international investigations pointed to the mistake of military Iran, which, as it turned out, acted in conditions of increased combat readiness because of the threats of possible attacks by the United States. Then, as Canadian experts consider the PS752 flushing, the result of the M-1 Air Defense Command error, where the Thor M-1 complex has mistakenly discovered the fire, Ukraine and a number of other countries consider this incident intentional. Earlier, Oleksiy Danilov, Secretary of the NSDC of Ukraine, said that Iran deliberately knocked down the plane, which is why Tehran refuses to give Ukraine full access to the scene for the investigation. In April 2023, it became known that one of the plane involved was sentenced to 13 years in prison. The prosecution notes that the commander of the air defense complex launched two missiles without the permission of the command and contrary to the relevant instructions.
This lawsuit brought to Iran to the International Criminal Court is another stage in the legal struggle between countries that were affected by catastrophe. The decision in the case can have far -reaching consequences for international relations and further investigation of this tragedy.
