Recently, the media flew a video from the wedding of the judge of the Northern Economic Court of Appeal Marina Barsuk (in the maiden - Didychenko), who was held in 2021, and except for the official income of Ukrainian high -ranking officials, there was one noticeable guest on the version.
The operator filmed Igor Kolomoisky at the wedding celebration of Judge Marina Barsuk, who considered several cases in which he appeared.
According to the Unified State Register of Judgments, Judge Barsuk made a decision in two cases related to Kolomoisky.
The first of them concerns the claim of the Nikopol Ferroallov Plant against Privatbank. In 2009, PrivatBank provided a loan of $ 36.1 million in Kolomoisky. The Decree of the Northern Commercial Court of Appeal overturned a debt of $ 35 million.
The second thing concerns PJSC "Ukrnafta", which is also associated with Kolomoisky. The panel of judges, which included Barsuk, left the court decision to recover from the state budget UAH 1.77 million in favor of Ukrnafta as a material damage.
In addition, Judge Barsuk made a decision in cases related to the sub -businessman Paul Fuchs.
In one of these cases, the panel of judges, which included Barsuk, confirmed the decision of the court of first instance in favor of LLC "Credit Finance", a company associated with FUks
In another case, the panel of judges, which also included Barsuk, left the decision of the court of first instance in favor of LLC "Verdict Capital", another company related to Fuchs.
So we decided to ask Marina Barsuk's career.
Career starts
The history of Marinna Barsuk, and then Didychenko began in 2009 after the election of Yanukovych to the post of President, the head of the Kyiv Commercial Court Vasyl Sanyuk began to think about the future. In this case, he was actively assisted by the young judge, which he selected - cynical and greedy.
The importance of this court in the system of economic courts of Ukraine is difficult to overestimate - large companies are trying to obtain a capital registration, so it is here that almost all serious economic disputes in the country are resolved. This makes the judge in the Kyiv Commercial Court not only honorable but also very profitable.
Vasyl Saryanyuk, who was the chairman of the court for several years, was the head of this informal union.
The scheme of Sanyuk was based on a group of approximate judges among whom Mykola Yakimenko, Alexander Mandrichenko, Sergey Kovtun, as well as young judges - Rostislav Stashkov Sergey Wise and Marina Didychenko .
Maryna Didychenko's father then held a high post at the Kyiv Prosecutor's Office, which provided close cooperation with this institution. The Sanyuk group actively interacted with the Deputy Prosecutor General Alexander Shinalsky and his partner, the former prosecutor of Podilskyi district Vasyl Dragovoz.
The activity of the judicial cooperative was particularly clearly manifested in interaction with the Russian Alfa Bank. This financial structure was known in Ukraine by the use of "crisis" technologies for the selection of property. The President of the Court Sanyuk distributed cases of Alfa-Bank for consideration only by "right" judges, including Marina Didychenko.
In turn, Marina Didichenko actively contributed to the financial interests of Alfa-Bank. In 2009, at least 15 court decisions were in favor of the bank. These are only those cases that the Commercial Court voluntarily sent for publication in the Unified State Register of Judgments.
Alfa-Bank defendants often faced the fact that decisions were made without their participation, which violates the basic principles of justice. Considering that the minimum dachshund for a positive decision was 5% of the amount of the claim, the "earnings" of banking judges were significant. For example, the total amount of penalty to 10 cases of Marina Didichenko in favor of the bank was $ 13,612 820 and 16 033 268 UAH. It is clear that most of this amount went to the chairman of the court of Sanyuk. So, in part of these cases, it could earn a minimum of $ 680 thousand and more than 800 thousand hryvnias, it should be recalled that the dollar cost 8 UAH in 2009.
After such a rise, Marina Didychenko did not hide her luxurious life , despite official modest income.
Despite its modest official salary of 4 thousand hryvnias a month, Didichenko lived in a spacious three -room apartment on Obolon Lipki in Kiev. An apartment with a total area of 132 square meters is estimated at about $ 400,000. The question arises: where does such funds from a judge who receives such a meager salary? Perhaps it is a gift from her father, prosecutor Anatoly Yakovenko, or from other "grateful" court clients?
Interestingly, Marina Didychenko and her ex -husband owned several parking spaces in underground parking, although no car was officially registered. However, there is a suspicion that they could use her mother's cars, Antonina Yakovenko, who worked in a private kindergarten. This modest caregiver owned three cars at once: chewed Mersedes Benz GL 450 (2008), Chrysler Pt Cruiser (2004) and the old Mersedes 600 (1997).
Marina Didychenko's vacations were also not limited to modest trips. In 2009, she visited Croatia and Arab Emirates.
According to the same scheme for the decomposition of property, in the program "Last warning" on the first national journalists revealed the scheme of work of Ukrsotsbank, it was in 2013, due to which hundreds of families in Odessa can be left without housing. In September 2008, Ukrsotsbank stopped financing the construction of housing, which has been waiting for hundreds of Odessans for five years. Due to the conflict with the developer, the bank seized apartments and five unfinished ones, which were paid for by investors.
The developer - the Alliance Corporation - signed a loan agreement with Ukrsotsbank for UAH 55 million. However, the bank suddenly refused to issue money, declaring the lack of hryvnia in its accounts. The developer was forced to sign an additional agreement on a foreign currency loan. After receiving the third tranche, Ukrsotsbank stopped funding unilaterally, which led to freezing of construction work.
The courts of Ukrsotsbank took place according to one scheme. The Bank hired a law company "Boyarchukov, Alexeyev and partners", which filed a lawsuit with the Commercial Court of Kyiv on the collection of property in favor of the bank. The consideration of the case was always entrusted with Marina Didychenko, who, before, is a cousin of lawyer Sergey Boyarchuk. The court made a decision in just one meeting, transferring all the property of the client of the bank.
Such a scheme allowed the bank to receive ownership of any property, which confirms its effectiveness in defending the interests of the bank to the detriment of ordinary people.
And these are only 2 precedents, and how much Marina Didichenko (Barsuk) has been enriched between 2009 and 2013
The appearance of Sergei Alekseev and the Kiev Deriban
In the summer of 2015, the People's Deputy and Deputy Chairman of the Verkhovna Rada of Ukraine Committee on Legal Policy and Justice Sergey Alekseev was exposed in corruption and lobbying of the interests of his law company Alexeyev, Boyarchukov and partners.
According to media reports, MP Sergei Alekseev instructed to transfer the judge of the Economic Court of Appeal Marina Didychenko an amount of $ 5,000 on her bank card. In addition, Alekseev negotiated that Didichenko Marina will help in making the decision he needed another judge, which is confirmed by the relevant audio recordings. Going in advance, let's say that Didychuk and Alekseev then had a relationship .
As a result, on October 14, 2014, Marina Didychenko made a positive decision in favor of client Sergei Alekseev, PJSC “Ukrsotsbank”.
Therefore, thanks to the cooperation of Marina Didichenko with her cousin Sergiy Boyarchuk's company, People's Deputy Alekseev Sergey received a map blanche for a scam for enrichment.
In 2016, an important company "Khimnafthemashproject" became the object of disputes , which could lead to its closure. The Institute, which has been engaged in projective activities for decades, was threatened by the interests of influential persons who liked the premises in the center of Kiev in Pechersk. The main asset of the institution is a building of 6000 square meters. m on Lesya Ukrainka Boulevard, which houses the Scientific Laboratory and the Archive of Projects of Strategic Plants of Ukraine.
The history began in March 2013, when a fabricated shareholders gathering took place, at which they decided to make a "chemical -flakproject" as a guarantor for a loan of almost UAH 300,000,000. For two dubious company in order to resold the company's property for debt.
Six months later, the employees of the Chemical Processes managed to change the management, and the new team began to challenge previous decisions in court. The company began to return to normal work, engaged in the projects of important social and industrial facilities such as kindergartens, hospitals and ports. However, in 2016, the projects were again threatened by blocking the decisions of the Kyiv Court of Appeal.
After a detailed analysis of the archives of cases, it became clear that in all court sessions, where "Khimnafthemashproject" was defeated, the same judge - Marina Didychenko participated.
It is worth noting that all its decisions, as well as the decision on the Kimnaftemash project, were canceled by the next court, but neither the resonance in the press nor the threat of investigation of its actions was stopped by the judge.
Also in the course of these litigation was the obvious direct connection of Marina Didichenko with deputy Sergiy Alekseev, whose law company, according to a happy coincidence, served Ukrsotsbank.
And already in 2019, a loud scandal , connected with the activities of an organized criminal group, which took possession of a real estate owned by the territorial community of the city began. It is a non -residential building at ul. B. Khmelnitsky, 34B, which is located near the famous hotel "11 Mirrors", which belongs to the brother of the mayor of Kiev Vladimir Klitschko (owner of LLC "Vit-Plus"). It was because of this neighborhood that manipulations with the real estate object.
On July 23, 2019, the Territorial Administration of the State Bureau of Investigation in the city of Kyiv initiated criminal proceedings on criminal acts committed by employees of the Kyiv City State Administration (KSCA) in conspiracy with the People's Deputy of Ukraine and representatives of private business. The charges relate to the seizure of property of the territorial community.
The applicant and the victim in this proceeding was Capital LLC, which in 2005 received the status of the investor of the reconstruction of the specified non -residential house. However, the investment contract was later terminated on the basis of a doubtful decision, and the object was transferred to LLC "Alternative", which was to create a museum and a library in the premises. In particular, the panel of judges of the Kyiv Commercial Court of Appeal, which reviewed the said case, included Judge Marina Didychenko, who was married to the People's Deputy Sergey Alekseev.
Alternative LLC belonged to Valery Arakcheev, which was the director of two more companies-Telbin LLC and E-Group LLC. These companies are related to the relatives of the People's Deputy from the UDAR party Vitaliy Klitschko. Subsequently, LLC "Alternative" was purchased by Sergey Boyarchukov, business partner Sergei Alekseev.
Summarizing Kyiv Mayor Vitaliy Klitschko, using his power and political influence, organized the necessary decisions, and Alekseev, together with his civilian wife, Didychenko ensured termination of the investment agreement in court. Boyarchukov, in turn, issued a lease agreement and ownership of the object in favor of LLC "Alternative".
Later, the corrupt scheme of termination of the investment agreement and the seizure of the reconstruction object was disclosed by a journalistic investigation and covered in the media. According to Boyarchuk, he tried to cooperate with the 11 Mirrors Hotel, but met resistance from the investor.
In fact, LLC "Alternative" did not create a museum or library, but uses a premises to maintain a hotel owned by Vladimir Klitschko.
Subsequently, the Kyiv City Council began the process of privatization of this object, and despite the appeal of Capital LLC, electronic auctions still took place. The winner was a company, the ultimate beneficiary of which is the offshore company Vladimir Klitschko.
Cooperation with Fuchs
In 2019, Investochils Vesta, which has ties with persons related to oligarch Pavel Fuchs, began to pursue an aggressive policy of buying strategic Ukrainian enterprises, undermining their efficiency and ability to function. One of these enterprises was the Bilotserkovsky Rosava Tire Plant, which is a key manufacturer of car tires in Ukraine. Earlier, this asset belonged to the former MP Konstantin Zhevago.
In 2019, the Investment Company "Investochils Westa" purchased 25% of Rosava assets. After Fuchsa received control of the plant, the arbitration manager of the enterprise was changed. Further actions, according to journalists, were aimed at bankruptcy of the plant and its further sale for scrap.
An important role in these events was played by Judge Marina Barsuk (Didichenko). According to the media reports of August 2022, as a judge, she considered lawsuits related to Investokhils Vesta, and made decisions that contributed to the company to achieve its goals.
The actions of Judge Didychenko contributed to the strengthening of the positions of "Investochils Vesta" in the case with the plant "Rosava". This was made possible by its personal connections with influential persons, which raises the issue of conflict of interest and possible corruption. Despite numerous appeals and complaints from other participants in the trial, the court decisions made with the participation of Didichenko, during a full -scale invasion, were aimed at supporting the interests of "Investochils Westa".
This situation can have serious consequences for the region's economy. The Bilotserkovska TPP, the shareholder of which is Rosava plant, could be at risk of stopping, did FUKS know about the plans of Russians to destroy Ukraine's energy?
Marina Borsuk's married life
Returning to the wedding of Marina Barsuk (Didichenko) and Viktor Barsuk - lawyer and Master of Law.
Judge Marina Barsuk does not hide her admiration with luxury and comfort . She dreams of heading the Southern Commercial Court of Appeal. And how convenient for her husband, lawyer Victor Barsuk, who is ready to invest in his wife's career. Why declare real estate when you can declare a whole car park, including Mercedes-Benz S580/2021, G63AMG/2019, S600/2009 and EQV/2021? Why not miss a real estate instruction if you just can't do it? It's brilliant, isn't it?
And, of course, there is no conflict of interest in the fact that the husband is a lawyer in cases that his wife is considering. This is obviously just a coincidence. Like their lifestyle, hundreds of thousands of euros and francs declared, all of this for one judicial salary.
According to the declaration of Judge Marina Barsuk, her family owns four apartments in Kiev and one in the United Kingdom - there lives the son of Marina Anatoliivna, Privalov Timur Artemovich. He may be studying for a pilot or a tank - it cannot be that the son of a Ukrainian judge evades mobilization, right?
The family also has a driver, a garage, a dwelling house and three land, all in Kiev. According to the declaration, their cost is 30 117 983 hryvnia. One of the apartments in Kiev was purchased for UAH 12,746. According to the declaration, of course.
The fleet is also striking - Judge Barsuk's family rides on new Mercedes, who have four. Judge Marina Barsuk herself, of course, could not afford such a luxury because of a small salary, so cars belong to other persons who allow them to use it. What kind of good people in our country!
As for money, the lawyer's family also does not suffer from a lack of funds. Marina Anatoliivna herself declared 455,000 hryvnias and $ 44,000 in cash, and she also has a bank deposit worth UAH 130 517.
The man, the richer - he has $ 600,000, 500,000 euros, 2,000,000 hryvnias and 350,000 Swiss francs, and in cash.
There is another interesting story with gifts: Maryna Barsuk, pensioner Mykola Barsuk, presented to his son (judge's husband) Viktor Nikolaevich Barsuk a gift in the form of "monetary form" worth 20 051 060 UAH, which he then transmitted to his favorite wife.
Interestingly, it was a gift and why no one in the NAPC asked where the pensioner with an annual pension of 80 166 hryvnias the opportunity to make such gifts.
Like the people of their circle, the family of leopards had several bright episodes. For example, in 2021 they were noticed at the birthday of the oligarch Pavel Fuchs. This is not surprising, because Viktor Barsuk represented Fuchs's interests in court where Marina Barsuk worked.
There was also a scandal around the Poltava GOC, where Barsuk acted in the interests of Kolomoisky and Russian Financial and Criminal Group Babakov. But these are all the little things for real professionals, because there is no conflict for them.
Viktor Barsuk is not just a lawyer, but a figure with a striking track record. His advocacy covers a wide range of cases, including corporate disputes, protecting the interests of large businessmen and even political figures. Barsuk is known for its ability to find the "gray zones" in the legislation and successfully use them to protect the interests of its customers. Among its clients can be found famous oligarchs, international companies and even representatives of the political elite.
He began to earn especially during the presidency of Petro Poroshenko, working on Alexander Granovsky, a curator of the legal sphere in Poroshenko. Barsuk was a "black lawyer" who was engaged in the technical implementation of many questionable cases. Formally, Granovsky, as a deputy, almost did not appear in the Council, holding his business meetings at expensive restaurants in Kiev. He coordinated the activity of Barsuk, who, thanks to "manual" judges won the majority of legal battles.
Barsuk and his partner on the Equity Advocacy Oleg Malinevsky used raider schemes, organizing the filing of identical claims to different courts to select a "right" judge. Among their high-profile affairs include the interests of companies in scandalous tenders, protecting the interests of businessmen and politicians, as well as raider seizures of large real estate, such as Sky Mall and Business Center "Horizon Park".
They also represented the interests of the former head of the State Fiscal Service Roman Nasirov, who is accused of theft of more than two billion hryvnias. In this case, Barsuk even accompanied Nasirov in court on stretchers, depicting it infirm.
