You don't serve, you pay: will it be possible for conscripts to go abroad - Iryna Borysenko

In social networks, they talked about the possibility of conscripts to travel outside Ukraine during martial law. In particular, the references to the Verkhovna Rada (September 13 last year) were more frequent, the bill No. 8029, which proposes it under the conditions of guaranteed financial support of the Armed Forces of Ukraine.

We will remind, the initiator of the bill was made by MP Georgy Mazurash, who believes that Ukrainian workers abroad for more than 10 years were considered the largest investors of our country.

Like, from open sources it is known that on the eve of the war, in 2021, employees "brought to Ukraine" about $ 13 billion. Therefore, the deputy believes that granting such persons permission to travel abroad at the expense of monthly contributions to the budget will contribute to a guaranteed positive effect in the form of: reducing the number of citizens who cannot provide themselves and their family; increase of financial support for the Armed Forces of Ukraine; strengthening of the economy and defense capability of the state; Reduction of the degree of socio-economic tension.

The content of the bill is focused on those who plan to leave and stay outside Ukraine in exchange for payment of one -time "passing" payment to the budget and guaranteed monthly payment of funds to the budget.

However, the document built on the principle of "departure for money", the People's Deputies on the Committee on Social Policy and the Protection of Veterans' Rights were not supported, considering its provisions discriminatory for society and creating unnecessary tension.

However, now this bill is gaining large -scale public support, which may probably contribute to such changes.

The bill provides for changes to the current Law “On the Procedure of Departure from Ukraine and the entry of Ukrainian citizens of Ukraine”, instead of adopting a new separate Law of Ukraine. And, if approved, it will allow men and women who are conscripts to go abroad, during martial law, provided:

  • They have at the date of departure of a personal account in one of the state banks of Ukraine with a guarantee contribution in the amount not less than five subsistence minimums for able -bodied persons (set at the time of departure). Currently, one subsistence level for able -bodied persons is UAH 2,684. Accordingly, a guaranteed contribution to a personal account of those who want to go abroad should be UAH 13 420;
  • Replenishment of a personal account monthly in an amount equal to taxes on a minimum wage - 18% of personal income tax, 1.5% of military levy and 22% of a single social contribution. Now the minimum wage is UAH 6,700, respectively, the amount of all taxes will be UAH 2 780;
  • granting a notarized statement to the relevant State Bank a notarized application for a voluntary obligation to replenish this account (with a contribution) on a monthly basis for the same amount of taxes from the minimum and permission to transfer a monthly funds to the Armed Forces.

In such circumstances, the conscript person traveling outside the country should open the account in the state bank in his name, make a one -time payment in the amount of UAH 13 420 and replenish it on the amount of UAH 2 780 on a monthly basis.

Such conditions will only be related to those who will travel abroad after the adoption of the said bill.

At the same time, in order to return to Ukraine, such citizens will have to present evidence of such conditions during their stay abroad, in particular, account statements for the entire period of stay outside the country, which will confirm the monthly replenishment of their account and write off their accounts with their accounts.

And the military citizens of Ukraine who have left Ukraine during the martial law are not under the conditions stipulated in the bill, and do not have documents confirming the right to defer from the conscription for military service during mobilization, for entry into Ukraine, they have a voluntarily transfer to a special amount able -bodied citizens (officially established in Ukraine on the day of entry into Ukraine), for every month of stay outside the country.

That is, for each month of stay outside the country during the action of martial law, conscripted citizens of Ukraine who left abroad before the date of adoption of this bill will have to pay UAH 26,840 for each month of stay abroad before the date of entry into Ukraine.

Only conscientious, proper, full and timely fulfillment of the above conditions will enable military citizens to return to Ukraine without interruption.

The conditions described in the bill are temporary. However, in the case of its adoption, they will last not only during the martial law in Ukraine and mobilization, but during a special period in the country, which will also partially cover the reconstruction period after the end of hostilities. Thus, it is likely that its conditions can be quite long. And these terms can not be predicted or calculated.
