At the first meeting of the updated National Security and Defense Council of Ukraine, a decision was made to introduce a moratorium on business checks. It is a temporary termination of planned and unscheduled inspections by law enforcement, customs, tax and other controlling bodies. This was reported by Prime Minister Yulia Sviridenko.
From now on, control will be exercised exclusively in a point, in cases where there are or likely real risks. This approach, according to government officials, will eliminate the pressure on entrepreneurs and focus on situations that pose a threat to the economy or security.
In addition, the reform provides a digitalization of the entire state supervision system. This is expected to eliminate manual interference with checking processes and minimize subjective solutions.
Sviridenko also reported that the prosecutor's office and law enforcement agencies have already started an audit of open criminal proceedings against entrepreneurs. According to preliminary data, 30 percent of such cases have already been closed due to the lack of a crime or evidence.
The task of the initiative is to create a predictable environment for entrepreneurship, eliminate administrative pressure and prevent new unfounded persecution.
The government is also preparing to submit a package of laws aimed at systematic business protection to the Verkhovna Rada. It is, in particular, to amend the Criminal Procedure Code of Ukraine and other normative legal acts.
According to the initiative, only the Prosecutor General or Heads of Regional Prosecutor's Office will be able to open new criminal proceedings against entrepreneurs. In cases where the arrested property or documents interfere with the work of the enterprise, such restrictions will be canceled.
Particular attention will be paid to the so -called "suspended" criminal cases, which are without motion for a long time and do not have sufficient evidence. Such proceedings are planned to be closed as part of the cleaning of the system from abuse and excessive pressure.
