On Tuesday, June 18, the Verkhovna Rada adopted the Bill No. 9316 on amendments to the disciplinary statute of the Armed Forces of Ukraine on renewal in the former military rank during martial law.
286 people's deputies voted in favor of this decision.
The bill was developed for the renewal of servicemen in the rank who had previously been deprived of the titles in disciplinary order, for the exemplary performance of official duties and combat missions. This will use their professional and organizational skills, military and special training, as well as combat experience during martial law. The renewal is proposed as a form of encouragement.
For this purpose, the bill proposes to amend the disciplinary statute of the Armed Forces. The absence of a rule on the order of renewal of officers in the event of cancellation creates legal uncertainty and discriminates servicemen who selflessly pass the service, have appropriate competence, education and experience, and are motivated to release Ukraine from Russian occupiers.
In particular, it is proposed that during the martial law, the officers who are deprived of the title in disciplinary order are renewed in the former title, regardless of the position they occupy, subject to positive certification. The renewal will be carried out by orders of the chiefs, under whose subordination they serve. If there is no relevant official (through the disbanding or liquidation of the military administration), the order shall be issued by the highest official. Prior to the renewal of the officer in the former rank and the assignment of the next title of re -deprivation of the title is not allowed. Persons renewed in rank will enjoy the rights and privileges established by the legislation in accordance with the renewed title. The submission of the necessary documents is carried out in due course.
