A new bill has emerged in Ukraine, which provides for criminal liability for representatives of the territorial centers of completion (TCC) and the military-medical commissions (VLK) for violation of the mobilization procedure. It is an important innovation that can significantly change the practice of mobilization in the country, in particular, in compliance with the law in conducting military assembly and completing the Armed Forces of Ukraine.
According to the information on the website of the Verkhovna Rada, the bill No. 12442 has already been registered in parliament. This document makes significant changes to the Criminal Code of Ukraine, namely, it introduces criminal liability for the heads of the CCC, heads and members of the VLC for violation of the requirements of legislation in the field of defense, mobilization training and mobilization. The bill provides for responsibility for several violations, in particular for the wrongful mobilization of persons who are not subject to conscription, or for violation of the established order when setting reservists. One of the most discussed points is punishment for military committees for mobilizing those citizens who have a booking or are unreasonable for health or other criteria.
The main initiators of the bill are deputies from the "servant of the people", members of the Verkhovna Rada Committee on Law Enforcement Maxim Pavlyuk and Alexander Bakumov. They believe that with the onset of wartime, responsibility should be mutual: if citizens are responsible for violation of military accounting rules, then the same responsibility should be for persons engaged in the organization of mobilization. It was also emphasized by MP Maxim Buzhansky, who previously stated the need to introduce such changes to the legislation. According to him, military committees should be responsible for the mobilization of booked persons, as well as those who are not subject to conscription. The authors of the initiative are also the head of the General Staff of the Armed Forces Anatoliy Bargilevich and Lieutenant General Alexander Pavlyuk. They have believed that a violation of the order of mobilization and military accounting can have serious consequences for the country's defense capability.
The new bill is of great importance in martial law, as it will provide additional transparency and control over mobilization processes, which are critical for maintaining the Armed Forces.
