In its decision of December 28, the Supreme Court of Israel determined that same -sex couples can now use the right to adopt children, taking into account the third paragraph of the Law on Adoption. The aforementioned paragraph previously argued that "only a couple of husband and wife has the right to adoption," and until now it was interpreted as a restriction of heterosexual couples.
In 2017, a lawsuit was filed, which urged to admit that this definition could also be included in same -sex unions. The court rejected this claim because the state promised to amend the legislation. However, the authorities have recently recognized the lack of specific terms to amend the legislation on this issue.
Thus, the Supreme Court acknowledged that the definition of "pair of husband and wife" could also be considered in relation to same -sex families. It is worth noting that in July 2021, this court also made a decision that allows for same -sex couples and lonely men to use surrogate motherhood.
