Elections during martial law, legislative gaps and threats to Ukraine

The People's Deputy of Ukraine Bogdan Kitsak stated that Russia can use a pause in hostilities, as well as the beginning of the election process to task strategic strike in Ukraine. He expressed anxiety about the possible problems that will arise during the upcoming elections, in particular for servicemen who are at the front.

According to Ukrainian law, there is no clear regulation to date if the brigade commander or other high -ranking office of the Armed Forces will be elected to the authorities during the war. The law does not state what actions should be taken in a state of martial law where these persons may be appointed or elected to political positions. Also, it is not at present to vote in the front lines. According to Kitsak, the main question is whether the fighters at the front will vote during the election. In addition, he raised the question of the possibility that the commander of the brigade who wants to run will be forced to leave his position, which can have a negative impact on combat readiness. At the same time, the deputy noted that the legislation of Ukraine did not determine how to act in such a situation. “What will happen when the brigade commander, who is trusted by their fighters, will leave the front through the elections? Who will be the responsibilities of management of the unit? These are very important questions that, unfortunately, there are no answers, ”Kitsak emphasized. The politician also expressed concern that Russia can take advantage of pause in hostilities after termination of martial law for strategic offensive. According to Kitsak, it is necessary to have firm guarantees that Russia will not use the conditional "truce" to prepare for new offensive actions. "We need to ensure that, after possible termination of hostilities, Russia will not restore the offensive campaign during the election process," the deputy said.

Ukraine has a special law on social and legal protection of the military, which states that the military has the right to run and vote, but cannot be members of political parties. However, this law does not state how to act in a state of martial law or during the war. This issue remains open to further legislative initiatives.
