In 2025, the rules of alimony in Ukraine remain strict, even if the payer is an unemployed, serviceman or an individual entrepreneur. Minimum amounts, penalties, features of the procedure - disassemble all important parts.
From January 1, 2025, the subsistence minimum remained unchanged: for children under 6 years - 2563 UAH, for children from 6 to 18 years - 3196 UAH. Accordingly, minimum alimony is 50% of this amount: UAH 1281.5 for children under 6 years; 1598 UAH - for children from 6 to 18. Alimony can be charged in a simplified way - by applying for a court order. Under this order, the court immediately sets a share of income: ¼ - for one child, ⅓ - for two children, ½ - for three or more. But there are two conditions: the child resides with the plaintiff, the payer must be registered in Ukraine.
The unemployed is not exempted from the obligation of the child. If the income does not receive, the contractor counts the debt based on the average salary in the region. Debt is calculated even without actual payments, according to Art. 195 Family Code. An entrepreneur individual pays alimony in a proportion from income or fixed amount. But the nuances depend on the tax system: the general system - it takes into account net income after taxes and confirmed expenses. Simplified system - the average wage in the region is taken. Alimony can be deducted from all military income, including additional payments for martial law, except for non -permanent cash. If the debtor is mobilized, the documents are transferred to its military unit or the Ministry of Defense, and then to accounting.
In case of non -payment of alimony, the executor may: impose a fine; prohibit car driving; limit traveling abroad; to introduce to the Unified Register of Debtors; initiate criminal liability. Debt level and consequences: more than 3 months - possible collection of property; more than 4 months - temporary restrictions (departure, weapons, driving, etc.); For more than 6 months - administrative protocol and fine: 20% of the debt amount - more than a year, 30% - over 2 years, 50% - more than 3 years.
