Ukrainians were indignant for detention of men by territorial centers of staffing on the streets and their loading to "beads". However, the Tax Code has received official permission for such actions under certain conditions.
This was reported by a representative of the Verkhovna Rada Defense Committee Fedir Venislavsky. According to him, employees of the Tax Code can only detain men in cooperation with the police. If the delay and loading of the beads happen without police, it is considered illegal. However, if they take place with the participation of law enforcement, they are legal.
Venislavsky emphasized that during the verification of documents, if it turned out that the citizen is wanted due to evasion of mobilization or has already received summons, the National Police has the right to detain him and deliver it to the relevant units of the Tax Code and the JV. Typical staff can only participate in such detentions with the police.
Lawyers recommend that in the event of illegal detention or "bell", be sure to find out the name of the person or group of persons performing such actions. This will allow you to sue for abduction and violation of mobilization. It is worth knowing your rights and being ready to protect them in the legal field, especially in the conditions of war, when many processes can go beyond the law.
Pursuant to Article 146 of the Criminal Code of Ukraine, unlawful imprisonment or theft of a person is punishable by restriction of liberty for a term up to three years or imprisonment for the same term. Therefore, any actions that do not comply with the law can be appealed in court.
Therefore, the Tax Code can perform the Busik operation, but only if cooperated with the police. Citizens should be armed with knowledge of their rights and their willingness to protect them in the legal field.
