A man who became a victim of illegal debiting of funds from a PrivatBank credit card appealed to the court because the bank continued to deduct interest for using the credit limit, even after returning the amount debited through a terminal in the US.
On May 30, 2023, 22,475 hryvnias were debited from the PrivatBank client's card due to 14 transactions conducted in dollars and carried out outside of Ukraine. The man claimed that he did not conduct or confirm these operations. When contacting the bank, they explained to him that the money transfers were made through the Privat-24 system, and stated that he allegedly violated the conditions of non-disclosure of login data.
The Marganets city court of the Dnipropetrovsk region partially satisfied the claim of a client of PrivatBank. The bank was ordered to return 112 hryvnias illegally written off. In addition, the court found the charging of interest for the amount of 22,326 hryvnias written off on March 30, 2023 illegal. This accrual of interest for the period from July 1, 2023 to the present time was deemed illegal by the court and obliged the bank to stop writing them off.
The court confirmed that PrivatBank violated the consumer's rights by illegally debiting funds for unauthorized operations and illegally charging interest for using the credit limit. The bank is obliged to return the illegally debited funds to the client and to stop further accrual of interest.
