The Pechersk District Court of Kyiv made a decision that became an important precedent in the protection of consumer rights and financial institutions. In February 2025, the court granted PrivatBank's claim against a client who has stolen 117 thousand hryvnias from a credit account.
According to the information published on the portal "The Single State Register of Judgments", the incident occurred in May 2022, when unknown persons were able to access his bank account due to phishing attacks and inattention of the client. The woman who was on one of the online sites for sale of goods accidentally moved to the fraudulent link, tying her card to the third-party site and providing data to enter "Privat-24". This allowed the criminals to carry out several transactions totaling UAH 84.85 thousand.
PrivatBank immediately reported law enforcement agencies and launched an internal investigation, finding that all operations were performed before the woman reported fraud. In view of this, the Bank demanded to collect a debt of UAH 117 thousand (95.33 thousand hryvnias - the body of the loan and UAH 21.66 thousand - interest).
The client refused to pay the debt, filed a counter -claim against the bank, trying to declare transactions invalid. However, the court made a decision in favor of the bank, noting that all financial transactions were carried out before the woman reported fraud. As a result, the court refused to satisfy the counterclaim of the client and satisfied PrivatBank's request for debt collection.
A woman must pay the bank 117 thousand hryvnias because of her own carelessness in protecting personal data. The court pointed to its negligence and inaction in preventing fraud, which was the main reason for the loss of funds.
