The court allowed drivers not to show their rights at roadblocks

Drivers in Ukraine received new arguments to protect their rights during checkpoints. The Ukrainian courts are increasingly making decisions in favor of drivers who refuse to make a driver's license at the request of police at checkpoints.

According to the Cabinet Resolution No. 1456 of 29.12.2021, the activity of checkpoints is regulated by clear rules. Police and other authorized persons have the right to check the documents confirming: the driver's person (eg, passport); ownership of the vehicle; the presence and content of the cargo, if any. However, the driver's license in this list is not referred to as a mandatory document for checkpoints. The driver should only bring the rights in the case of a reasonable stop by the police, which is related, for example, to violation of traffic rules (traffic). In this case, the police officer is obliged: to introduce himself by calling his name, title and position. Specify the specific reason for the stop. If the driver refuses to grant the rights after fulfilling these conditions, it will be considered an administrative offense that entails a fine of 425 UAH.

Lawyers emphasize that in case of refusal to present a driver's license on a checkpoint, penalties are not applied. Moreover, Ukrainian courts almost always make decisions in favor of drivers in such situations. Drivers may be limited to presenting a passport to confirm their person. This exhausts police or other officials on checkpoints. Keep calm and politely communicate with the checks. If the claim seems illegal, ask the reason for the check and refer to the Cabinet of Ministers No. 1456. In the event of a conflict or dispute, fix the situation with video recording (under the law).

Such recommendations will help drivers uphold their rights and reduce the risk of conflicts at checkpoints.
